Terms & Conditions

1. General provisions

These General Terms and Conditions (hereinafter: GTC) govern the services provided and products sold by HIDRA-MIX Kft. (registered address: 1106 Budapest, Jászberényi út 24-36., company registration number: 01-09-162919, tax number: 10681824-2-42 — hereinafter: Seller) through the cupal.hu website.

The GTC apply to all legal relationships arising between the Seller and the Buyer (hereinafter: Parties) in connection with quote requests, orders and deliveries made through the cupal.hu website or by email.

By submitting a quote request or placing an order, the Buyer accepts the provisions of these GTC.

The Seller reserves the right to unilaterally amend the GTC. Buyers will be notified of changes on the website.

2. Quote requests and orders

The Seller's products are available for purchase exclusively based on individual quotation. Information shown on the website is for guidance only and does not constitute an offer.

Ordering process:

  1. The Buyer specifies the required product type, dimensions, quantity and other relevant information via the quote request form on the website, via chat or by email.
  2. The Seller evaluates the request on business days and sends an individual quotation to the Buyer by email.
  3. The Buyer accepts the quotation in writing (by email), thereby completing the order.
  4. The contract becomes final upon the Seller's order confirmation.

The quotation remains valid for the period stated therein, or in the absence of such a period, for 30 days from the date of the quotation.

3. Prices and payment terms

Prices are always stated in the individual quotation. Prices are net prices to which VAT at the applicable statutory rate is added.

Payment methods:

  • Bank transfer: The Seller issues an invoice after order confirmation. The payment deadline is 8 calendar days from the date stated on the invoice, unless the Parties agree otherwise.
  • Advance payment: The Seller may require advance payment (50-100%) for first orders or high-value orders.

In the event of late payment, the Seller is entitled to charge statutory default interest.

4. Shipping

The Seller ships throughout the entire European Union.

Shipping conditions:

  • Lead time: The delivery deadline is specified in the quotation. For standard products typically dispatch within 48 hours, for custom cutting 5–10 business days, delivery within the EU 2–5 business days.
  • Shipping cost: Stated in the quotation. Depends on weight, dimensions and destination.
  • Shipping method: By courier or freight, depending on product size and weight.
  • Risk transfer: Risk of damage passes to the Buyer upon receipt of the goods.

The Buyer must inspect the product upon delivery and immediately notify the courier and Seller of any damage.

5. Complaints and warranty

Visible defects:

The Buyer must inspect the product within 8 business days of receipt and notify the Seller in writing (by email) of any defects. Failure to do so results in loss of warranty rights for visible defects.

Hidden defects:

For hidden defects, the Buyer must notify the Seller within 30 days of discovery, but no later than 6 months from delivery.

Complaint handling:

  • The Seller will investigate the complaint within 15 business days.
  • For valid complaints, the Seller may, at its discretion, replace, repair or offer a price reduction or refund.
  • Warranty does not cover damage caused by improper use, incorrect storage or processing.

6. Limitation of liability

The Seller's liability for defective performance is limited to direct damages and may not exceed the net purchase price of the complained product.

The Seller is not liable for consequential damages, lost profits, production losses or other indirect damages.

The Buyer is responsible for proper use of the product and compliance with applicable technical requirements.

7. Force majeure

In the event of force majeure (e.g. natural disaster, war, epidemic, governmental measures, strike, material shortage, transport disruption), the Parties are released from their contractual obligations for the duration of the force majeure event.

The affected Party must immediately notify the other Party of the force majeure situation.

If the force majeure situation persists for more than 90 days, either Party may withdraw from the contract.

8. Applicable law and disputes

These GTC and the legal relationship between the Parties are governed by Hungarian law, in particular the provisions of the Civil Code (Act V of 2013).

The Parties will attempt to resolve disputes primarily through negotiation. Failing that, the Parties submit to the exclusive jurisdiction of the Budapest District X and XVII Court or the Metropolitan Court of Budapest, depending on the value of the claim.

9. Final provisions

If any provision of these GTC is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Amendments to contracts between the Parties are only valid in writing (by email).

These GTC were prepared in Hungarian. In the event of any discrepancy, the Hungarian version shall prevail.
